1).Purpose

Welcome to the Healthana.co website which includes our country-specific websites, mobile websites, mobile apps, blogs and website for programs like Rewards, Reviews Program, and Autoship & Save Program (collectively, the “Site”). This Healthana.co Terms of Use Agreement ("Agreement") sets forth the agreement between Healthana W.L.L, with its main office at Adliyah, Office no. 105 1st floor, Building 256, road 2705,block 327, Kingdom of Bahrain, with commercial registration certificate no. 172391-1 (collectively, “Healthana.co”, “we”, or “us” , and each user ("user", "your" or "you"). This Agreement governs your use of the Site, Healthana.co Rewards Program (“Rewards Program”), theHealthana.co Autoship & Save Program (“Autoship & Save”), the Healthana.co Reviews Program (“Reviews Program”), and the Healthana.co Privacy Policy (“Privacy Policy”). Please read this Agreement carefully and fully before using the Site or participating in the Rewards or Reviews Program or Autoship & Save or disclosing to us any personal information.

By using the Site and/or participating in the Rewards Program or Reviews Program or Autoship & Save, or disclosing to us any personal information: (i) you agree that you have read and understood the terms of this Agreement, (ii) you accept and agree to be bound by the terms of this Agreement, and (iii) you accept and agree to abide by all laws and regulations applicable to the subject matter of this Agreement.

IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT ACCESS OR OTHERWISE USE THE SITE OR PARTICIPATE IN THE REWARDS PROGRAM OR REVIEWS PROGRAM, OR DISCLOSE TO US ANY PERSONAL INFORMATION.

The terms in this Agreement may change periodically and may be revised at any time and from time to time at our sole discretion by updating this posting. You should visit this page from time to time to review the current terms of use because they are binding on you. Your continued use of the Site and/or Participation in the Rewards Program, Reviews Program, and or Autoship & Save means that you accept any changes or modifications to this Agreement. If any modification is unacceptable to you, your only recourse is to terminate this Agreement by contacting Customer service. Certain provisions of the terms contained in this Agreement may be superseded by legal notices or terms located on particular pages of the Site, or through specific programs terms for the Rewards Program, Reviews Program, and Autoship & Save .

2). Code of Conduct

Healthana.co code of conduct is included in this Agreement. Participants in Healthana.co Rewards Program and Reviews Program, customers, vendors, visitors to the Site, and stakeholders are expected to comply with the Code of Conduct.

3). Not Healthcare Advice

The products and claims made about specific products on or through the Site have not been evaluated by the United States Food and Drug Administration and are not approved to diagnose, treat, cure, or prevent disease.

The Site is not intended to provide diagnosis, treatment, or medical advice. Products, services, information, and other content provided on the Site, including information that may be provided on the Site directly or by linking to third-party websites are provided for informational purposes only. Please consult with a physician or other healthcare professional regarding any medical or health related diagnosis or treatment options.

Information provided on the Site and linked websites, including information relating to medical and health conditions, treatments and products may be provided in summary form. Information on the Site including any product label or packaging should not be considered as a substitute for advice from a healthcare professional. The Site does not recommend self-management of health issues. Information on the Site is not comprehensive and does not cover all diseases, ailments, physical conditions, or their treatment. Contact your healthcare professional promptly should you have any health-related questions. Never disregard or delay medical advice based upon information you may have read on the Site.

Links to or access from any third-party websites or resources is not an endorsement of any information, product, or service. We are not responsible for the content or performance of any third-party websites. Use of any third-party websites is at your own risk.

Comments made in any forums on the Site by employees or Site users are strictly their own personal views made in their own personal capacity and are not claims made by us or do they represent our positions or views. Product ratings by any current or previous employees or Site users are strictly their own personal views made in their own personal capacity and are not intended as a substitute for appropriate medical care or advice from a healthcare professional. We are not liable for any information provided on the Site regarding recommendations regarding supplements for any health purposes.

Always check the product label or packaging prior to using any product. If there are discrepancies, customers should follow the information provided on the product label or packaging. You should contact the manufacturer directly for clarification as to product labeling and packaging details and recommended use.

 

 

4). Product Purchases

To the extent you make purchases on the Site, you agree that all purchases of products are made pursuant to the respective INCOTERMS designated upon order placement. Title for any products purchased by you will transfer upon our delivery to the carrier.

It is your responsibility to ascertain and comply with all applicable local, state, federal, and international laws regarding the receipt, possession, use, and sale of any item purchased from this Site.

When ordering from Healthana.co you are responsible for assuring the product can be lawfully imported into your country. Customers are the importers of record and must comply with all laws and regulations of the destination country.

Healthana.co reserves the right to prohibit purchases of any merchandise to resellers. Resellers are defined as a company or an individual that purchases goods with the intention of selling them rather than using them. Healthana.co does not support sales tax exemption requests for businesses or resellers.

5). Usage & Termination

By using our Site and/or participating in the Rewards Program, Reviews Programs and/or Autoship & Save, you represent and agree that you are at least eighteen (18) years of age or older and are fully able and competent to agree to the terms in this Agreement or any Program terms and conditions. If you are under the age of 18, you are not permitted to use this Site or participate in any Program.

6). Account Setup & Use

You may be required to establish an account on the Site to use certain features. When creating an account, you agree to provide accurate, true, complete, and current information about yourself as prompted by the Site and to promptly update such information to maintain accurate, true, complete and current information. If you provide any inaccurate, false, incomplete, or outdated information or we in our sole discretion suspect that such information is inaccurate, false, incomplete or outdated, we reserve the right to suspend or terminate your account and prohibit any and all current or future use of the Site or any portion thereof by you. During the registration process you will create a username and password. You are responsible for the confidentiality of your account and password and are fully responsible for all activities that occur under your account or password. You agree to immediately notify us of any unauthorized use of your account or password or any other security breach and to ensure that you exit from your account at the end of each session. You agree to be responsible for all charges resulting from the use of your account on the Site including charges resulting from unauthorized use of your account. We are not liable for any loss or damage resulting from your failure to comply with this section.

7). Use of the site

You agree to use the Site and engage in the Programs for lawful purposes and that you are responsible for your use of and communications on the Site. You agree not to post on or transmit through the Site any unlawful, infringing, defamatory, obscene, indecent, threatening, offensive or otherwise objectionable material of any kind including any material that encourages illegal conduct or conduct that would encourage civil liability, infringe on other's intellectual property rights or otherwise violates any applicable local, state, national or international law. You agree not to use the Site in a manner that would interfere with normal operation or infringe on any others use of the Site.

You agree not to access the Site by any means other than the interface we provide. Displaying or running the Site or any information or material displayed on the Site in frames or through similar means on another website without our prior authorization is prohibited. Any permitted links to the Site must comply with all applicable laws, rules and regulations.

 

8). Termination or Suspension of the Agreement

This Agreement is effective until terminated by either us or you. We, in our sole discretion, may suspend or terminate this Agreement at any time without notice and deny you access to the Site or any portion of it. You may terminate this Agreement at any time by contacting Customer service (Cusromerservice@healthana.co) and discontinuing all use of the Site and the Rewards Program, Reviews Program, and Autoship & Save. Upon termination by us or you, you must destroy all materials obtained from the Site including all copies of such materials whether made under the terms of use contained in this Agreement or otherwise. We reserve the right to modify or discontinue, temporarily or permanently, the Site or any portion of it with notice to you.

9). Account Termination

We reserve the right to terminate any account if your order is deemed fraudulent or credit card charges are disputed. You agree that we may terminate or suspend your access to all or part of the Site, with or without notice, for any conduct that we, in our sole discretion, believe is in violation of any part of this Agreement, laws or regulations or is harmful to another user or us or our affiliates.

The following shall survive any termination of the Agreement either by us or you; Privacy, Liability Disclaimer, Severability; Interpretation, and Miscellaneous.

10). Google Maps/Google Earth

Some areas of the Site implement Google Maps/Google Earth mapping services. Your use of Google Maps/Google Earth is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

11). Pricing

With respect to items sold by Healthana.co, we cannot confirm the price of an item until you order. Despite our best efforts, a small number of the items in our catalog may be mispriced. Subject to applicable law, if the correct price of an item sold by Healthana.co is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation.

12). User Content and Conduct

 Included in this Agreement. All User Generated Content must comply with the guidelines which are a binding part of this Agreement. Additionally, all User Generated content should comply with the Code of Conduct in this Agreement. User Generate Content, including product reviews, solely reflect the views and opinions expressed by the contributor and not those of Healthana.co. Healthana.co does not verify or endorse any claims made in reviews. Statements regarding dietary supplements have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease or health condition.

13). Privacy

By agreeing and adhering to the terms of this Agreement, you also confirm that You understand Healthana.co Privacy Policy. To learn more about what we do with your information please review the Healthana.co Privacy policy.

14). Consent to Communications

You consent to receive SMS messages (including text messages) from us to the specific number(s) you have provided to us with information or questions about your account and/or orders.

You may also have elected to receive marketing and promotional SMS messages (including text messages) from us. Your consent to receive marketing and promotional SMS messages is not required to purchase goods or services. If you have elected to receive SMS marketing messages, we will send you an SMS to confirm your election. Message and data rates may apply, and message frequency may vary. Carriers are not liable for delayed or undelivered messages.

You certify, warrant, and represent that the telephone number you have provided to us is your contact number and not someone else's. You represent that you are permitted to receive calls and text messages at the telephone number you have provided to us. You agree to promptly alert us whenever you stop using a telephone number. Healthana.co may use such means of communication described in this section even if you will incur costs to receive such messages, text messages, e-mails, or other means, which may occur.

You can stop receiving SMS messages (including text messages) at any time by replying “STOP” to any message you receive from us, and we will send you a message confirming your election. If you want to start receiving messages again, sign up as you did the first time. If you need help, text “HELP” to any message you receive from us or email customerservice@healthana.co. Message and data rates may apply, and message frequency may vary. Carriers are not liable for delayed or undelivered messages.

15). Programs

Your participation in the Programs is voluntary and is effective until terminated by either Healthana.co or you.

Healthana.co Rewards Program

Rewards Program Period

The Rewards Program is on-going, and participation is subject to the terms and conditions set forth herein (“Rewards Program Period”).

Eligibility

The Rewards Program is open to all Healthana.co account holders who are at least eighteen (18) years of age or older at the time of participation. Purchases made through the guest checkout feature are not eligible for Rewards Program participation or benefits. This Rewards Program is void where prohibited or restricted by law. Your participation in the Rewards Program and use of Your Rewards Link and Rewards Code (as each is defined below), constitutes your full and unconditional agreement to the terms set forth in this Agreement, and Healthana.co decisions and interpretations, which are final and binding in all matters related to the Rewards Program. I

General Rewards Program Information

Subject to the above eligibility requirements, you may participate in the Rewards Program when create a valid account on the Site. When You create a valid account, you will be enrolled in this Rewards Program and be deemed a participant in the Rewards Program in order to receive credits towards Your future Healthana.co purchases (“Rewards Credits”).

Rewards Credits earned under this Rewards Program from making referral and writing review can only be used by You towards Your future purchases made on the Site or can be redeemed for cash (cash out option is not available in all countries.

You can receive Rewards Credits when new and existing customers that You refer to Healthana.co (“Referred Customer”) place qualifying orders using Your Rewards Link or Rewards Code.

16). ONLINE ORDERING PROCESS

  1. The ordering process consists of the following steps:
    1. you add the Products which you wish to purchase to your shopping cart.
    2. if you would like to send your order as a gift, you can choose to have it gift wrapped at the delivery options stage of the ordering process, and you will then be offered the opportunity to add a gift note with a personal message to the additional notes section.
    3. you provide an address for delivery, a billing address, and any requested payment information.
    4. you will be asked to read carefully and then accept the T&Cs.
    5. before submitting your order, you will have a final opportunity to review the Products to be purchased and their prices (including any additional charges and fees such as delivery costs) and all of the information you have submitted; and
    6. you will click ‘Submit’ to finalize your order.

17). ORDERING ERRORS

You can correct errors on your order up to the point at which you click on ‘submit order’ on the final page of our ordering process.

18). ACKNOWLEDGMENT AND ACCEPTANCE OF YOUR ORDER

We will notify you by e-mail as soon as possible to acknowledge receipt of your order and to provide you with an order number. If we are unable to fulfil your order following this acknowledgement, we will contact you by e-mail or telephone advising you of this. We will confirm acceptance of your order by sending you an email that confirms that the Products have been dispatched (“Dispatch Confirmation”). A legally binding contract between us will be formed when we send you the Dispatch Confirmation (or, in the unlikely event that a Dispatch Confirmation is not sent due to a processing error when we dispatch the Products to you) (“Contract”). If you require any information concerning your order, please e-mail us at customerservice@healthana.co quoting your order number. We may not accept your order if a product you have ordered is out of stock, if we have identified a Product or pricing error, or if we are unable to obtain authorization for your payment. Please note that we reserve the right to reject any offer to purchase by you at any time.

19). PAYMENT

Payment can be made through any of the following methods: Visa and Mastercard. Payment will be debited and cleared from your account at the point at which your order has been placed. You confirm that the credit or debit card being used is yours. Please note that all credit/debit cardholders are subject to validation checks and authorization by the issuer of the card. If the issuer of your payment card refuses to pay or does not for any reason authorize payment to Healthana.co , we will not be liable for any delay or non-delivery of Products. We retain the legal ownership of all Products until full payment has been made by you and received by us and legal ownership of the Products will immediately transfer back to us if we refund any payment for the Products to you. Risk in the Products transfers to you upon delivery.

20). YOUR CANCELLATION RIGHTS

You just need to let us know that you have decided to cancel. The easiest way to do this is to send an email included with your invoice number by emailing us at customer service@healthana.co. In any such e-mail or written communication, you must include details of your order, including your order number, to enable us to identify it. Your cancellation is effective from the date you send us the email.

IF YOU CANCEL YOUR ORDER WE WILL:

    1. Refund you the price you paid for the Products. However, please note we are permitted by law to reduce your refund to reflect any reduction in the value of the goods if this has been caused by your handling them in a way which would not be permitted in a store. If we refund you the price paid before we can inspect the goods and later discover that you have handled them in an unacceptable way, you will be liable to pay to us an appropriate amount.
    2. Refund any delivery costs you have paid, although the maximum refund will be the cost of delivery by the least expensive delivery method we offer (as permitted by law).
    3. Make any refund due to you as soon as possible and in any event within 14 days after the day on which we receive the products back from you or, if earlier, the day on which you provide us with evidence that you have sent the Products back to us.
    4. Exchanges: If you indicate on your cancellation email that you would rather receive an exchange than a refund then this will be processed within 7 working days of receiving your returned goods and will be delivered via standard delivery. In these circumstances, a new Contract will be deemed to have been formed between us in relation to the new Product you have selected (and your various rights of cancellation and return as set out herein will apply to that Product). In the event that we are not able to satisfy your request for an exchange then we will refund you the cost of the Products and the original Contract between us will be cancelled.

21). SALE

All sale and promotional items have been displayed and available to buy at the original, higher price for at least 28 days online before being reduced to the reduced price stated either on the site. Some items within the sale are promotional, therefore the prices of these items are subject to change and may increase after the sale period. Standard delivery of Sale purchases may take up to 7 working days. Sale items may take longer to arrive due to the volume of orders placed during our sale period. Please note that while all products remain in pristine condition, due to the nature of the sale some external packaging may appear slightly worn. Sale items cannot be gift wrapped. Please note that an item could go out of stock during checkout and your purchase is only confirmed once dispatched.

22). OUR LIABILITY FOR LOSS OR DAMAGE SUFFERED BY YOU

We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these T&Cs, we will be responsible for loss or damage that you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen (for example, if you discussed it with us during the sales process).

You agree not to use the Products for any commercial, business or resale purposes. We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

23). QUESTIONS AND COMPLAINTS

24). TRANSFER OF RIGHTS

We may transfer our rights and obligations under these T&Cs to another organization and we will always notify you in writing if this happens (but this will not affect your rights or our obligations under these T&Cs). You may only transfer your rights or your obligations under these T&Cs to another person if we agree in writing.
